Citation Options
Pay Fine
Choosing this option means you will be waiving your right to trial and entering a plea of guilty or no contest. Understand that this may result in a conviction appearing on either a criminal or driving record and that the state may charge surcharges and/or suspend your license. Driving Safety Course (DSC)
Choosing this option will allow you 90 days to complete the course and request a certified copy of your driving record from the Department of Public Safety in Austin. You can prevent the citation from going on your driving record by successfully completing this course. The violation for which you have been charged can be dismissed if you qualify.
If you fail to complete any one of the requirements by your due date, your case will be set for a Show Cause Hearing. A letter will be mailed to the address on your citation. There are no resets for a Show Cause Hearing except for an emergency that can be verified by a Court Supervisor.
If you fail to appear at the hearing, a Judgement of guilty will be entered without further notice and the violation will appear on your driving record unless you file an appropriate appeal bond with the Clerk’s Office no later than ten (10) calendar days from the judgement date.
You have ten (10) calendar days from the hearing date to either pay or appeal the Judgement before a capias pro fine warrant is processed. You may waive your hearing by writing to the Court waiving your Show Cause Hearing, and pay the remaining balance of the fine. Make all payments payable to the City of Nassau Bay.
Deferred Disposition (Probation)
This option is another method for you to have your violation dismissed to prevent the offense from appearing on your driving or criminal record. The deferral period is from a minimum of 90 days to a maximum of 180 days. You are required to pay the state court costs and post a cash bond in the amount of the special expense fee at the time of your request. You also may be required to take a driving safety course as a condition of your deferred disposition. Deferred disposition is similar to DSC in that it is only granted once a year to have a violation dismissed.
If you hold a Commercial Drivers License, you are not eligible for deferred disposition or driving safety course. State law prohibits the deferred disposition option if a violation occurs in a construction zone when workers are present.
Failure to Comply

If you fail to comply with the Order of Deferred Disposition, a show cause hearing will be held to determine if you had good cause for not complying with the Court’s order. If you fail to show good cause or fail to attend the hearing, a Judgment of guilty will be entered without further notice, and the violation will appear on your driving or criminal record unless you file an appropriate appeal bond with the Clerk’s Office no later than ten (10) calendar days from the judgment date.
