As of September 1, 2003, the State of Texas enacted a point system for certain traffic convictions. Each year, the Texas Department of Public Safety assesses a surcharge on a license of a person who has accumulated a specific number of points during the preceding 36-month period and this assessment is mandatory. See §708.052, et.seq. of the Texas Transportation Code.
Moving Traffic Violations
The points are:
2 points any moving violation.
3 points any moving violation that resulted in an accident.
No points are assessed if the violation was speeding and the alleged speed was less than 10 percent of the posted speed limit except if the speeding violation occurred in a school zone. Further, no points are assessed if a person successfully completes deferred disposition, a driving safety course or a motorcycle operator course.
